1. Who we are, and accepting these terms
Kamby is published by Raphael Saing, entrepreneur individuel (micro-entreprise), registered in France under SIREN 988 355 111, with its address at 1 rue Marguerin, 75014 Paris. You can reach us at support@kamby.app. The publication director is Raphael Saing.
The kamby.app website is hosted by Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA (+1 650 319 8930). This section serves as the site’s legal notice (mentions légales).
These terms are the agreement between you and us for the Kamby mobile app and the kamby.app website. By creating an account or using Kamby, you accept them. If you don’t accept them, please don’t use Kamby.
2. The service
Kamby is an educational product: a mobile app for learning the Khmer language.
Kamby is free while in beta.
Because it is a beta, features may change, appear, or disappear, and the content may contain errors. We do not warrant that the course is free of errors or that using it will produce any particular learning outcome. Kamby is a learning tool, not a certification, a translation service, or professional language advice.
3. Your account
When you first open the app, Kamby creates a guest account automatically so your progress is saved before you sign up. A guest account has no email and no name. You can later link an email address or your Apple ID and keep everything you’ve done. Guest accounts that stay inactive for 90 days are deleted, along with their data.
To sign in you use Sign in with Apple, an email magic link / one-time code, or an email & password. Keep your email account, your Apple ID and your password secure — anyone with access to them can access your Kamby account. Tell us at support@kamby.app if you think someone else is using your account.
Age. You must be at least 13 years old to use Kamby. In France, users under 15 need a parent or guardian’s permission.
Please keep to one account per person. Accounts are personal to you and you may not sell, share, or transfer yours.
4. Your licence to use Kamby
We give you a personal, non-exclusive, non-transferable, revocable licence to use Kamby and its content for your own learning. It is a licence for personal, non-commercial use.
You may not:
- scrape, crawl, or bulk-download the lessons, vocabulary, or audio recordings;
- copy, republish, resell, or otherwise redistribute our content, in whole or in part;
- use our content to build or train a competing course or language product;
- reverse-engineer the app, except where the law expressly allows it.
If you downloaded Kamby from the Apple App Store, the app itself is licensed to you under Apple’s standard EULA; these terms govern the Kamby service and your account, and apply alongside it.
5. Our content, and yours
The curriculum, the lesson texts, the audio recordings, the app design, the Kamby name and logo are ours or licensed to us. Using Kamby doesn’t transfer any of that to you.
Your feedback. When you send us a report through “report a problem”, you keep ownership of what you wrote. You grant us a free, worldwide, perpetual licence to use it to improve Kamby — to fix the bug, correct the lesson, or make the app better. We may sublicense that licence to the service providers who run Kamby, and it transfers with Kamby under section 12.
6. Acceptable use
Use Kamby normally and in good faith. Specifically, please don’t:
- abuse, threaten, or harass anyone, including us;
- attempt to break, probe, or circumvent the security of the app or our systems;
- access the service through bots, scripts, or other automated means;
- interfere with the service or with anyone else’s use of it;
- use Kamby for anything unlawful.
7. Privacy
What we collect and why is set out in our Privacy Policy, which forms part of your use of Kamby.
8. Availability and changes to the service
We don’t promise uninterrupted or error-free availability. We may modify, suspend, or discontinue features — or the service as a whole — as the product evolves. If a change would negatively affect your use of Kamby in more than a minor way, we’ll give you notice in the app or by email first.
9. Liability
To the extent the law allows: Kamby is a free beta learning tool, and we are not liable for indirect or unforeseeable losses arising from your use of it — for example lost data you had not saved elsewhere, or learning results you had hoped for.
Nothing in these terms limits or excludes rights that mandatory law gives you as a consumer, or liability that mandatory law does not allow us to limit or exclude.
10. Ending the agreement
You can stop using Kamby at any time. You can delete your account and all of its data from the app: Settings → Delete account (feedback reports you sent are kept in de-identified form, as the Privacy Policy explains). You can also write to support@kamby.app and ask us to do it.
We may suspend or close an account that breaches these terms — for example the misuse described in sections 4 and 6. Except in the case of a serious breach, or where the law requires immediate action, we’ll tell you first and give you a chance to put things right. Where the law requires notice, we give it.
11. Changes to these terms
We may update these terms as Kamby changes. The current version always lives at kamby.app/terms with the date it was last updated. For material changes, we’ll let you know in the app or by email before they take effect. Continuing to use Kamby after that means you accept the new terms; if you’d rather not, you can delete your account.
12. General
Transfer. We may transfer these terms, and the licences in them, to a company we create or to a successor that carries on Kamby, provided your rights under them are not reduced. We will notify you of any such transfer.
Severability. If any part of these terms turns out to be invalid, the rest stays in force.
Survival. The parts that by their nature outlive your account — the content rules in section 4, the feedback licence in section 5, section 9 on liability, and the governing-law rules in section 13 — survive its deletion.
13. Governing law and courts
These terms are governed by French law.
If you are a consumer residing in the European Union, this does not deprive you of the protection of the mandatory rules of the country where you live, and you keep the right to bring proceedings before the courts of that country.
